Актуальні європейські моделі децентралізації влади та перспективи їх впровадження в Україні

Abstract

У статті автори здійснили дослідження актуальних європейських моделей децентралізації влади та перспективи їх використання в Україні у теоретичному і практичному аспектах. Актуальність дослідження обумовлена тим, що принцип децентралізації успішно був реалізований в практиці держав Європейського Союзу і для України, у якій на сьогодні процес реформування державних інститутів остаточно не завершено, надзвичайно важливим є вивчення позитивного досвіду впровадження децентралізації та створення в ефективної моделі територіальної організації влади на усіх рівнях. З’ясовано, що одним із суттєвих недоліків української моделі організації влади на місцях є те, що місцеві органи виконавчої влади створюються і діють не з метою здійснення контрольно-наглядових функцій щодо законності діяльності місцевого самоврядування (як у західноєвропейських державах), а беруть на себе основний обсяг повноважень щодо управління відповідними територіями. На підставі проаналізованого досвіду європейських країн окреслено передумови успішної імплементації децентралізаційних процесів для створення ефективної моделі управління в системі децентралізованої влади України: утвердження принципу верховенства права; визнання та гарантії місцевого самоврядування; рівний правовий захист усіх форм власності; демократичне й ефективне виборче законодавство; незалежність, ефективність, доступність і прозорість судової системи, функціонування інститутів адміністративного судочинства; досконалий бюджетний процес та висока фінансова дисципліна; наявність адекватних соціальних стандартів; розвинутий громадський сектор та стійка тенденція до його розвитку. Висновується, що в Україні необхідно побудувати таку модель територіального управління, за якої влада спроможна в умовах ринкової економіки ефективно впливати на соціально-економічний і культурний розвиток територій, забезпечувати надання управлінських послуг населенню на рівні європейських стандартів, здатна до самовдосконалення і саморегуляції.

In this article, the authors have carried out a research of current European models of decentralisation of power and the prospects for their use in Ukraine in theoretical and practical aspects. The relevance of the study is due to the fact that the principle of decentralisation has been successfully implemented in the practice of the European Union, and for Ukraine, where the process of reforming state institutions has not been completed, it is extremely important to study the positive experience of implementing decentralisation and creating an effective model of territorial organisation of power at all levels. It is established that one of the significant drawbacks of the Ukrainian model of local government is that local executive authorities are established and operate not with the aim of exercising control and supervisory functions over the legality of local selfgovernment (as in Western European countries), but assume the bulk of the powers to manage the respective territories. Based on the analysed experience of European countries, the author outlines the prerequisites for successful implementation of decentralisation processes to create an effective model of governance in the system of decentralised power in Ukraine: establishment of the rule of law; recognition and guarantees of local self-government; equal legal protection of all forms of ownership; democratic and effective electoral legislation; independence, efficiency, accessibility and transparency of the judicial system, and functioning of administrative justice institutions; perfect budget process and high financial discipline; adequate social standards; a developed public sector and a steady trend towards its development. It is concluded that in Ukraine it is necessary to build a model of territorial governance in which the authorities are able to effectively influence the socio-economic and cultural development of territories in a market economy, to ensure the provision of administrative services to the population at the level of European standards, and are capable of self-improvement and self-regulation.
