Актуалізація міждисциплінарних досліджень в процесі правового регулювання державної безпеки України

Abstract

У дослідженні здійснено аналіз причин актуалізації міждисциплінарних досліджень у процесі правового регулювання державної безпеки та перспектив таких досліджень у майбутньому. Обґрунтовано, що наразі склалася ситуація, за якої наука функціонує сама по собі, а реальна політико-правова та безпекова діяльність тяжіє до автономності, ізольованості, сподівання на інтуїцію й суб’єктивні міркування, досвід тих, хто перебуває на відповідних посадах. Доведено, що загальні методологічні принципи його здійснення постійно перебувають у фокусі уваги вчених і регулярно висвітлюються. Здійснений аналіз публікацій рельєфно демонструє дві тенденції, що знаходяться у тренді науки: 1) міждисциплінарність досліджень, що дозволяє комплексно підходити до аналізу процесів, явищ, подій, об’єктивно інтерпретувати науково значущі факти; 2) російсько-українська війна зумовлює потребу у відході від суто теоретичних дискусій про абстрактні загрози і ризики, виклик та небезпеки, а займатися тим, що у міжнародній практиці називають діяльністю „спін-докторів”. Базуючись на методології науки, що створює концептуальні засади осмислення проблем держави і суспільства, які існують на сучасному історичному етапі, звертається увага на те, що новітні умови потребують розширення горизонтів і залучення до традиційно гуманітарної сфери здобутків технічних, біологічних та інших наук. Самі причини розподілені на дві великі групи: 1) ті, які детермінували розвиток науки у передвоєнний час; 2) ті, що доповнили існуючий перелік на етапі воєнного стану з лютого 2022 року. Оригінальність репрезентації матеріалів полягає в тому, що проекція на науки і наукові дисципліни демонструється крізь призму таких причин. Окреслені можливості міждисциплінарності з позицій прагматичного підходу, принципу поєднання теорії з практикою, інституціональних механізмів реалізації права.

The study analyzes the reasons for the actualization of interdisciplinary research in the process of legal regulation of the State security theory and the prospects for such research in the future. It is substantiated that currently there is a situation in which science functions on its own, and real political, legal and security activities tend to be autonomous, isolated, relying on intuition and subjective considerations, and the experience of those in relevant positions. It is proved that the general methodological principles of its implementation are constantly in the focus of attention of scholars and are regularly covered. The analysis of publications clearly demonstrates two trends that are in the trend of science: 1) interdisciplinarity of research, which allows for a comprehensive approach to the analysis of processes, phenomena, events, and objective interpretation of scientifically significant facts; 2) the Russian-Ukrainian war necessitates a shift away from purely theoretical discussions of abstract threats and risks, challenges and dangers, and to engage in what is known in international practice as “spin doctor” activity. Based on the methodology of science, which creates the conceptual framework for understanding the problems of the State and society existing at the current historical stage, the author emphasizes that the new conditions require expanding horizons and involving the achievements of technical, biological and other sciences in the traditionally humanitarian sphere. The reasons themselves are divided into two large groups: 1) those that determined the development of science in the pre-war period; 2) those that supplemented the existing list at the stage of martial law since February 2022. The originality of the presentation of the materials lies in the fact that the projection on the sciences and scientific disciplines is demonstrated through the prism of such reasons. The author also outlines the possibilities of interdisciplinarity from the standpoint of a pragmatic approach, the principle of combining theory with practice, and institutional mechanisms for the implementation of law.
